most economically advantageous tender for the Lot.
Lot 2 will contain one (1) range of suspension, which will be awarded as a single supplier framework based on
the most economically advantageous tender for the Lot.

Description of these options: Contract duration will be for twenty four (24) months with option on the part of the
Contracting Authority to extend by a period of up to twenty four (24) months by giving a minimum of one months

In accordance with the Public Contracts (Scotland) Regulations 2006 the Authority may treat as ineligible or and
decide not to select any economic operator on one of more of the grounds set out below. Accordingly economic
operators MUST in each case confirm whether or not any of the following apply, namely:
(a) Has the economic operator been declared bankrupt?
(b) Has the economic operator had a receiving order or an administration order or bankruptcy restrictions order
made against it/him/her?
(c) Has the economic operator made any composition or arrangement with or for the benefit of creditors or made
any conveyance or assignation for the benefit of its creditors?
(d) Has the economic operator appeared unable to pay or has no reasonable prospects of being able to pay a
debt within the meaning of Section 268 of the Insolvency Act 1986?
(e) Has the economic operator granted a Trust Deed for creditors or become otherwise apparently insolvent?
(f) Is the economic operator the subject of a petition presented for sequestration of its/his/her estate?
(g) Is the economic operator subject of any proceedings similar to those listed in paragraphs (a) to (f) above
under the laws of any other state?

It is a requirement of the Invitation to Tender that any Potential Framework Participant must be able to
demonstrate the existence of a valid and current UK/EMEA Marketing Authorisation for all Goods tendered at
date of submission of the tender.
The total value refered to is based on spend over the total contract period including the optional extension
period of up to 24 months.

VI.4.2) Lodging of appeals:
Precise information on deadline(s) for lodging appeals: The authority will incorporate a standstill period ofa minimum of 10 calendar days at the point information on the award of the contract is communicated totenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authoritybefore the contract is entered into. Applicants have 2 working days from notification of the award decision torequest additional debriefing and that information will be provided a minimum of 3 working days before expiry ofthe standstill period. Such additional information should be requested from the address in section 1.1.
If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts( Scotland) Regulations 2006 (SSI 2006 No.1) provide for aggrieved parties who have been harmed or are atrisk of harm by a breach of the rules to take action in the Sheriff Court or Court of Session. Any such actionmust be brought promptly (generally within 3 months). Where a contract has not been entered into the courtmay order the settling aside of the award decision or order the authority to amend any document and mayaward damages. If the contract has been entered into the court may only award damages.
